graduated lease 累进租赁;浮动租约    =index lease

A lease in which rent varies depending on future contigencies, such as operating expenses or gross income.

考虑到未来费用开支上涨的租赁。这种租赁合同中必须确定一个据以判断开支上涨的基准年。由于通货膨胀和水手、能源支出和其他费用的持续上涨,累进租赁变得比租金固定租赁【fixed-straight lease】更为普遍。

ground lease     总额租赁   =land lease;net lease;ground-rent lease

A long-term (usu. 99-year) lease of land only. 

Such a lease typically involves commercial property, and improvements built by the lessee usu. revert to the lessor.

由承租人交纳一笔总括的租金,而由出租人从中支付所有的费用,诸如水、气、电费。

master lease   主租赁

A contract that establishes a lease-hold's basic terms and conditions applicable to all related contracts for rental properties.

对后续租赁或转租有控制作用者。

net-net-net lease   纯粹净利租赁   =triple-net-lease

A lease in which the lessee pays all the expense, including mortgage interest and amoritization, leaving the lessor with an amount free of all claims.

承租人需支付包括抵押利息和分期摊付款在内的所有开支,而出租人仅收取无任何债务负担的款项,又称三重净利租赁。

operating lease  经营性租赁

A lease of property ( esp. equipment) for a term that is shorter than the property's useful life.

Under an operating lease, the lessor is typically responsible for paying taxes and other expense on the property.

一种财产租赁,尤其是设备租赁,其租期短于该财产的有效期间(使用寿命)。根据此种租赁合同,出租人负责交纳财产税和关于该财产的其他支出费用。

parol lease  口头租约

A lease based on an oral agreement; an unwritten lease.

无书面证据,仅基于口头协定发生的租赁。

percentage lease    比例租赁

A lease in which the rent is based on a percentage of gross (or net) sales or profits, typically with a set minimum rent.

常用于零售业的财产租赁,其租金根据毛销售额或净销售额的一定比例确定,一般约定由保底租金或最低租金。

proprietary lease    业主租约

A lease between a cooperative apartment association and a tenant.

合作公寓的业主公司与承租人订立的租赁协议。

"unless" lease    附条件租约

A oil-and-gas lease with a drilling-delay rential clause structured as a special limitation to the primary term.

Unless delay rentals are paid or drilling operations are started from time to time as specified, an "unless" lease automatically terminates, and the lessee has no liability for its failure to perform.

一种石油与天然气租约,它规定在项目无法进行商业运营或承租人不能支付租金时租约失效,承租人自动免除责任。租约中必须明确规定其在某确定时间失效,除非承租人开始商业运营或支付约定的租金。
