SUPPLY OF DOCUMENTS

6. Upon acceptance of the Tender1 2 copies of the drawings2 referred to in the Specification and of the Conditions of Contract the Specification and (unpriced) Bill of Quantities shall be furnished to the Contractor free of charge.3 Copyright of the Drawings and Specification and of the Bill of Quantities (except the pricing thereof) shall remain in the Engineer4 but the Contractor may obtain or make at his own expense any further copies required by him.5 At the completion of the Contract the Contractor shall return to the Engineer all Drawings and the Specification whether provided by the Engineer or obtained or made by the Contractor.6

FURTHER DRAWINGS AND INSTRUCTIONS

7. (1) The Engineer shall have full power and authority to supply and shall supply to the Contractor from time to time during the progress of the Works such modified or further drawings and instructions7 as shall in the Engineer’s opinion be necessary for the purpose of the proper and adequate construction completion and maintenance of the Works8 and the Contractor shall carry out and be bound by the same.

(2) The Contractor shall give adequate notice in writing to the Engineer of any further drawing or specification9 that the Contractor may require for the execution of the Works or otherwise under the Contract.8

DELAY IN ISSUE

(3) If by reason of any failure or inability of the Engineer to issue at a time reasonable in all the circumstances10 drawings or instructions requested by the Contractor11 and considered necessary by the Engineer in accordance with sub-clause (1) of this Clause the Contractor suffers delay or incurs cost then the Engineer shall take such delay into account in determining any extension of time to which the Contractor is entitled under Clause 44 and the Contractor shall subject to Clause 52 (4)12 be paid in accordance with Clause 6013 the amount of such cost as may be reasonable.14 If such drawings or instructions require any variation to any part of the Works the same shall be deemed to have been issued pursuant to Clause 51.15

ONE COPY OF DOCUMENTS TO BE KEPT ON SITE

(4) One copy of the Drawings and Specification furnished to the Contractor as aforesaid shall be kept by the Contractor on the Site16 and the same shall at all reasonable times be available for inspection and use by the Engineer and the Engineer’s Representative and by any other person authorised by the Engineer in writing.
