美法院叫停禁令，TikTok暂时无需下架

据美国消费者新闻与商业频道 （CNBC） 报道， 美国哥伦比亚特区地区法院27日裁决 ， 暂缓实施美国政府关于将TikTok从美国移动应用商店下架的行政令 。这一行政令原本将在数小时内生效。

A judge has temporarilyblockedan order from the Trumpadministration that would have banned TikTok from being downloaded from USapp stores.

一位法官宣布暂时叫停特朗普政府有关禁止从美国移动应用商店下载TikTok的行政令。

At the end of the day on Sunday, the USgovernment could haveforced app stores run byAppleand Google to remove TikTok.

美国政府原本要求苹果和谷歌应用商店在27日晚12点之前下架TikTok。

But after a hearing on Sunday,JudgeCarl Nicholsof United States District Court for the Districtof Columbia, granted aninjunctionagainst that order.

但在27日的听证会结束后，美国哥伦比亚特区地区法院法官卡尔·尼克尔斯宣布禁止这一行政命令。

在当天的电话听证会上，TikTok的律师称特朗普对该软件的打压违反了言论自由。

John Hall, an attorney for TikTok, argued that the app, with some 100 million American users, is a "modern day version of the town square" and shutting it down is akin to silencing speech.

TikTok律师约翰·霍尔认为TikTok在美国拥有1亿用户，相当于“现代的城市广场”，关闭它类似于禁止人们发表言论。

据了解，该法院并没有暂停美国政府将于11月12日起执行的禁止TikTok在美提供服务的禁令。

对于27日的判决，TikTok在一份声明中称：

“We’re pleased that the court agreed with ourlegal argumentsand issued an injunction preventing the implementation of the TikTok app ban. We will continue defending our rights for the benefit of ourcommunity and employees.

我们对于法院认同我们的法律论据，发布禁令阻止TikTok下架感到高兴。我们将继续为了社区和员工的利益捍卫我们的权利。

At the same time, we will also maintain our ongoing dialogue with the government to turn our proposal, which the President gave his preliminary approval to last weekend,into an agreement.

与此同时，我们还将继续与美国政府沟通，以期将我们在上周末获得美国总统初步批准的提议转化为协议。

据美国国家公共电台（NPR）报道，27日的判决使得Tiktok至少在下一次合议庭听证前（时间尚未确定），都能继续运营。

The judge's move means the Chinese-owned TikTok can now operate without interruption at least until a full court hearing. A full hearing date on the case has not yet been set.
